Welcome to GotTakeOut ("GTO," "we," "us," or "our"). GotTakeOut is a global food and travel editorial platform available at gottakeout.com and via our mobile application (iOS and Android). By accessing or using GotTakeOut, you agree to be bound by these Terms of Service. If you do not agree, please do not use our Service.

1. About GotTakeOut

GotTakeOut is an editorial food and travel guide — not a food delivery service or booking platform. We curate restaurant recommendations across 21+ cities worldwide, powered by AI and human editorial review. Restaurants listed on GotTakeOut are independently selected or pay for featured placement. GotTakeOut does not charge delivery fees, take commissions on orders (except via our opt-in Order Direct system), or handle food preparation.

2. Acceptance of Terms

By downloading the GotTakeOut App, creating an account, or using any part of our Service, you confirm that you are at least 13 years of age and agree to these Terms of Service and our Privacy Policy.

3. User Accounts

To access certain features (writing reviews, uploading photos), you may create a GTO account using your email address. You are responsible for:

Keeping your account information accurate and up to date
Choosing a username that does not impersonate GotTakeOut staff, other users, or third parties
All activity that occurs under your account

Usernames may not include: gottakeout, gto, admin, moderator, official, verified, staff, or similar brand-related terms. We reserve the right to reclaim or remove usernames that violate these guidelines.

4. User-Generated Content

When you submit reviews, photos, or other content ("User Content") to GotTakeOut, you grant us a non-exclusive, worldwide, royalty-free licence to display, distribute, and promote that content on our App, website, and marketing materials.

You agree that your User Content will:

Be honest, accurate, and based on your genuine experience
Not contain defamatory, offensive, or illegal content
Not infringe on any third-party intellectual property rights
Not include personal information about individuals without their consent

All reviews and photos are subject to editorial approval before being published. We reserve the right to reject, remove, or edit any User Content that violates these Terms or our editorial standards.

5. Order Direct

Our Order Direct feature allows participating restaurants to receive orders placed through the GotTakeOut App. GotTakeOut charges restaurants a monthly fee and takes 0% commission on orders. Orders are between the user and the restaurant directly. GotTakeOut is not responsible for order fulfilment, food quality, or delivery.

6. AI Concierge

Our GTO Concierge is an AI-powered dining recommendation tool. Recommendations are generated by AI and may not always be accurate or up to date. Restaurant details including hours, menus, and availability should be verified directly with the restaurant. GotTakeOut is not liable for any decisions made based on AI recommendations.

7. Intellectual Property

All content on GotTakeOut — including editorial articles, restaurant curation, logos, design, and the GTO Concierge AI — is the property of GotTakeOut or its licensors. You may not reproduce, distribute, or create derivative works without our express written permission.

8. Prohibited Conduct

You agree not to:

Use the Service for any unlawful purpose
Scrape, crawl, or extract data from GotTakeOut without permission
Submit false, misleading, or spam reviews or photos
Attempt to impersonate GotTakeOut staff or other users
Interfere with the security or operation of our Service
Use the Service to send unsolicited commercial messages

9. Disclaimers

GotTakeOut provides editorial recommendations for informational purposes only. We do not guarantee the accuracy, completeness, or timeliness of any restaurant information. Restaurant hours, menus, and availability are subject to change. Always confirm details directly with the restaurant before visiting.

GotTakeOut is provided "as is" without warranties of any kind, express or implied.

10. Limitation of Liability

To the fullest extent permitted by law, GotTakeOut shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to loss of data, revenue, or goodwill.

11. Termination

We reserve the right to suspend or terminate your account at any time for any reason, including violation of these Terms. You may also delete your account at any time by contacting us at policy@gottakeout.com.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be resolved through good-faith negotiation or, if necessary, binding arbitration.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last Updated" date. Continued use of GotTakeOut after changes are posted constitutes your acceptance of the revised Terms.
